General Terms and Conditions (GTC)
1. General
These General Terms and Conditions (GTC) apply to all orders placed through our online store www.spesclo.com. The operator of this online store and contractual partner is SPESCLO, a fashion brand based in Austria.
2. Conclusion of Contract
2.1. The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.
2.2. By clicking the "Buy" button, you submit a binding order for the goods in your shopping cart. Confirmation of receipt of the order is sent immediately after the order is placed. The purchase contract is concluded upon our order confirmation or upon delivery of the goods.
3. Prices and Shipping Costs
3.1. The prices listed on the product pages include the statutory value-added tax (VAT) and other price components.
3.2. In addition to the stated product prices, we charge shipping costs for delivery. The shipping costs are clearly displayed in the shopping cart system and on the order page.
4. Delivery Conditions
4.1. Delivery is available within Austria and worldwide.
4.2. Unless otherwise stated in the offer, the delivery time is 5-7 business days.
5. Payment
5.1. Payment can be made by bank transfer (prepayment), credit card, PayPal, or instant transfer (Sofortüberweisung).
5.2. If you choose prepayment, we will provide our bank details in the order confirmation, and the goods will be shipped after payment is received.
6. Retention of Ownership
The goods remain our property until full payment has been received.
7. Right of Withdrawal
Consumers have a 14-day right of withdrawal.
8. Consequences of Withdrawal
8.1. If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for additional costs resulting from choosing a delivery method other than the least expensive standard delivery we offer), without undue delay and no later than 14 days from the date we receive your withdrawal notification.
8.2. The refund will be processed using the same payment method you used for the original transaction, unless expressly agreed otherwise. No fees will be charged for this refund.
8.3. We may withhold the refund until we have received the goods back or until you provide proof that you have sent the goods back, whichever occurs first.
9. Warranty
The statutory warranty provisions apply.
10. Data Protection
10.1. We collect, process, and use your personal data only with your consent or if legally permitted.
10.2. The personal data you provide during the ordering process will be used exclusively for the fulfillment and processing of your order. Further information can be found in our Privacy Policy.
11. Applicable Law
Austrian law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
12. Final Provisions
If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, the relevant statutory provisions shall apply.
